Terms of Service

1. Agreement

By accessing or using PromptCanary ("Service") you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old and have the legal capacity to enter into a binding agreement to use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

3. Acceptable use

You agree not to:

• Use the Service to monitor endpoints you do not own or have permission to test.
• Attempt to reverse-engineer, scrape, or reproduce the Service.
• Use the Service to send traffic that constitutes abuse or a denial-of-service attack.
• Resell or sublicence access to the Service without our written consent.

4. Paid plans and billing

Paid subscriptions are billed in advance on a monthly or annual basis through Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing period and we do not provide pro-rata refunds for partial periods, except where required by applicable law.

We reserve the right to change plan pricing with 30 days' notice to existing subscribers.

5. Uptime and SLA

We target 99.5% monthly uptime for the monitoring scheduler. We do not provide a financially-backed SLA on Free or Pro plans. Team-plan SLA terms are available on request.

6. Data and privacy

Our Privacy Policy describes how we handle personal data and forms part of these Terms.

7. Intellectual property

The PromptCanary name, logo, and hosted service infrastructure remain our property. Nothing in these Terms grants you a licence to use our trademarks.

8. Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, our aggregate liability for any claim arising out of these Terms is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

9. Termination

We may suspend or terminate your access if you breach these Terms, with or without notice depending on the severity of the breach. On termination, your right to use the Service ends immediately.

10. Changes to these Terms

We may update these Terms. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which the operator is registered. Disputes will be resolved in the courts of that jurisdiction.
